Everlight filed a declaratory judgment action against Nichia Corporation (“Nichia”) for invalidity and non-infringement of U.S. Patent Nos. 5,998,925 and 7,531,960 in the U.S. District Court for Eastern District of Michigan in 2012. These two patents are directed to YAG phosphor being used in LEDs and phosphor concentration. The court confirmed that all asserted claims of Nichia’s patents were invalid. Aside from the U.S. court ruling, Everlight has receive favorable rulings in Japan and Taiwan that Nichia’s patents are invalid.

On June 30, 2016, Seoul Viosys announced that the U.S. Federal District Court for the Southern District of Florida issued a judgment in favor of Seoul Viosys against Salon Suppl, a company that sells UV LED curing device (“Salon Supply”). In the judgment, Salon Supply acknowledged infringement of Seoul Viosys’s asserted patents as well as their validity. Salon Supply agreed to pay past damages, as well as a license fee, and to stop using unlicensed infringing products.

Cree, a leader in LED lighting, has filed counterclaims in the U.S. District Court for the Middle District of North Carolina against Feit Electric Company, Inc. to stop infringement of Cree’s patented technologies. The suit alleges infringement of two patents related to LED bulbs.

On April 18, 2016, United States District Court for the Northern District of California entered judgment in accordance with the jury’s verdict in Enplas Display Device Corporation v. Seoul Semiconductor Co., Ltd. (N.D. Cal., Case No. 3:13-cv-05038-NC) that EDD’s sale of light diffusion lenses #9854D, #9854E and #9879 in Japan and Taiwan induced unnamed parties to infringe claims 1, 6, 33, 34 and 35 of United States Patent No. 6,473,554 (USP ‘554) and its sale of those lenses and lenses #4922 and #9853A in Japan and Taiwan induced unnamed parties to infringe claim 20 of United States Patent No. 6,007,209 (USP ‘209) (under 35 U.S.C. § 271(b)).

Seoul Semiconductor announced that it won a patent infringement lawsuit regarding LED backlight lens technology against Japanese lens maker Enplas.

One year ago, Seoul Semiconductor filed a patent infringement lawsuit in U.S. Federal District Court asserting that Craig’s sales of LED backlighting unit products infringed five of Seoul’s patents. On July 23, 2015, the court finally issued the judgment in favor of Seoul Semiconductor stating that Craig acknowledged infringement of all the asserted patents and their validity.

Although, Nichia might be losing ground in its recent patent infringement case against Everlight in Eastern Michigan Courts, the company announced winning two separate patent lawsuits including a joint lawsuit filed by Taiwanese rival Everlight and Emcore. The company has also been dismissed by Northern California Courts as in the patent infringement lawsuit filed by non-practicing entities (NPE) Bluestone Innovation. Everlight also demands the courts declare Nichia patent nos. 5,998,925 and 7,531,960 void.
