Nichia Corporation (Nichia) has filed yet another patent infringement against Everlight Electronics (Everlight). The Japanese company recently filed legal action against the Taiwanese company’s customer Arrow Electronics Australia in the Australian Federal Court for infringing on Nichia’s YAG patent (Australian Patent No. 720234). 

Nichia Corporation (“Nichia”) and Emcore Corporation (“Emcore”) reached an agreement to settle a patent infringement lawsuit in the United States District Court for the Eastern District of Texas, in which Emcore acknowledges the validity of the USP 7,295,587, and makes a payment to Nichia for past damages and for royalties in the future.

EMCORE Corporation, a provider of compound semiconductor-based components and subsystems for the fiber optics and space solar power markets, announced that it has settled the patent infringement case brought by Nichia Corporation before the U.S. District Court for the Eastern District of Texas.

Everlight Electronics Co., Ltd. ("Everlight") brought an invalidation trial on September 5th, 2011 against the Japanese Patent No. 4,530,094 ("JP'094") owned by Nichia Corporation ("Nichia"). Everlight recently received a prevailing decision from the Japan Patent Office.

On April 10, 2014, Nichia Corporation has filed a patent infringement lawsuit in Tokyo District Court to enjoin Tachibana Eletech Co., Ltd. and E&E Japan Co., Ltd.  from infringing Nichia’s patent (No. 3786114 and No. 3972943) and to claim damages for the infringement with regard to LED products (product number: 1254 series) after analyzing the LEDs purchased from Tachibana. 

GE Lighting today announced the settlement of a patent infringement lawsuit filed in December 2012 against CRS Electronics Inc.

In response to Nichia Corporation’s (Nichia) press release regarding the order entered by the United States District Court for the Eastern District of Michigan, Everlight notes that the order referenced in Nichia’s press release relates to discovery disputes and is not a substantive ruling on the merits of any of Everlight’s claims or defenses.  The orders are not related to the merits of patent infringement or validity and therefore have no effect on Everlight’s products.  Also, Everlight have produced relevant LED list and samples in compliance with the Court’s Order.

Everlight responds to Nichia's amendment complaint concerning the U.S. patent litigation.

On November 22, 2013, Nichia Corporation filed an amended complaint in its on-going patent infringement lawsuit against Taiwanese LED manufacturer Everlight Electronics Co., Ltd. and Everlight’s U.S. subsidiary Everlight Americas, Inc. (collectively “Everlight”), originally filed on September 11, 2013, in the U.S. District Court for the Eastern District of Texas.

Everlight responds to Nichia's press release on November 7th regarding Chinese Patent Nos. ZL97196762.8 and ZL03159595.2 (YAG patents).

Japanese LED manufacturer Nichia announced recently , it had received the court verdict from the Beijing First Intermediate People's Court pertaining to the decision by the State Intellectual Property Office’s Board of Patent Appeals and Interferences that Nichia’s two YAG patents (ZL97196762.8, ZL03159595.2) were valid.

Taiwan LED packaging manufacture Everlight and Japanese LED manufacture Nichia’s patent war continues with both sides refusing to back down. The dispute however has not affected J.P. Morgan’s outlook for Everlight’s Q3 and Q4 operations. J.P. Morgan believes that recognized earnings for street light bids and German subsidiary WOFI’s recognized earnings for the second half of the year will be expected to increase around 10 percent for Q3. Revenue for Q4 is expected to continue rising.
